Punching the Disinfo Machine

This Spotify dust-up is fascinating, isn’t it? I spent much of the last 48 hours talking with people about it, explaining what’s going on, and mildly debating it (though please remember that I don’t argue on the internet). People have questions and there’s still a lot to understand about a situation that’s starting to feel like a runaway train. I thought it would be fun and helpful to do a self-Q&A to clear up some things and offer an opinion on why I believe this is a meaningful moment.


• Why pick on Spotify? There are awful content and disinformation podcasts distributed by Apple, Amazon, and more. Is it hypocritical to leave Spotify but remain with the others?

It’s hard not to argue that under late capitalism any large corporation will end up going down a dark path (just ask the folks who eventually removed “Don’t be evil” as their unofficial motto). Thus sole reliance on any corporation, especially for one’s artistic output, is something to avoid whenever possible. There’s also the messy perception of shared endorsement when the platform one relies on does nasty things.

While disinformation is undesirable on any platform (and the climate change denial stuff concerns me just as much as the pandemic stuff) there is a difference in how Spotify participates in its distribution. Spotify’s relationship with Joe Rogan’s podcast involves a layer that’s more complex than other negligent platforms that host disinformation podcasts.

Spotify paid Joe Rogan over 100 million dollars for exclusive rights to the podcast. That’s a lot. And artists and subscribers aren’t entirely wrong in feeling like they help pay for that by utilizing the platform. And, by paying this much for a single property, it’s in Spotify’s interest to relentlessly promote that property. In my experience, Rogan’s podcast is the top podcast recommendation on the Spotify dashboard a lot more often than it isn’t. I’ve never listened to a podcast through Spotify in my life but, almost without fail, there it is. Recommended for me and, I’m sure, recommended for you as well.

Those are the things that Neil Young et al. find most disturbing, which differ from, say, how Apple hosts toxic podcasts on its platform. This doesn’t excuse Apple or anyone else — pretty much every platform is guilty to some degree. Which I think is another reason why we’re picking on Spotify: there’s a sense of helplessness in the sea of disinformation and targeting Spotify feels slightly hopeful. It’s a message delivered to a company financially invested in the disinformation and a tangible loss (in invested money or share price) might make other platforms think twice.

Admittedly, this sounds quixotic. But I don’t think that’s a reason not to strive for a world we’d like to live in.

• Why are Neil Young and Joni Mitchell the ones pulling music off Spotify and not any current top artists?

The particulars of major label artist deals are varied and tricky and often put the artist at a disadvantage in distribution decisions with their catalog. (I released three albums through a major in the late ’90s and there is no way that I’m able to pull those off Spotify.) No matter how big newer artists are (and I’m talking ones who came up in the last 20 years) they are most likely still locked into contracts that last multiple releases and decades. So, it’s not surprising that ‘legacy’ artists are ones able to do this as they’ve gone through at least a few renegotiations, theoretically able to get better terms and more control each time.

But — many legacy artists also have their hands tied, thanks to those huge payout publishing acquisition deals that have been happening. Neil Young may have negotiated the final say over where his songs can appear in his recent deal (and Warner Bros is an accomodating partner) but it’s possible Bob Dylan or Bruce Springsteen didn’t. We don’t know. Related: this tweet from David Crosby.

• What about Taylor Swift? She kept her music off Spotify before. Wasn’t the whole point of leaving Big Machine Records to gain control of her music rights?

As for Taylor Swift, we can only guess at why she won’t (or will she) do anything. She did sign a new deal with Universal Music Group after her fights with Spotify and Apple, so her amount of control may have changed (and I assume she was aided in those fights by a label that was apparently sympathetic with her wishes, which would be ironic). Yes, her owning her masters was publicly a big part of the Universal deal, but I bet that ownership comes over time (10 years after the release date on a recording, for example) rather than right away — but different than the perpetuity of her Big Machine terms so better for her in the long run.

Plus, the fact that Swift has an antagonistic relationship with her former label which controls most of her recordings probably means she couldn’t remove everything even if Universal agreed.

• OK, if the artists can’t remove music from Spotify shouldn’t they at least all speak out?

Yes, a lot of these artists that don’t have control over their recordings could and probably should speak out — and some are! But there’s the danger everyone doing the “thoughts and prayers” thing could become performative overkill and fade with no real bite like tweeting a black box did. In my opinion, if an artist really wants to make an impact, don’t mention Spotify at all in posts, on the artist’s website, and in public (unless to occasionally remind listeners not to go there) — send fans to other platforms. Bandcamp’s a great choice.

• I can’t help but think that Neil Young and Joni Mitchell won’t have enough impact. Only older music fans care about them, not the demographic that Spotify wants to reach.

Hey, I’m a Gen X’er who likes Neil Young — I was converted after seeing him out-feedback Sonic Youth in the early ’90s. But, okay, Neil and Joni may mainly appeal to the ‘olds.’ You know what, though? Large and important parts of the music industry are still being run by the olds (including the journalistic side). The impact may be subtler and greater than you might think.

• Where do you think this is going?

My hope is that we’re another step closer to a split in the music industry and how music is consumed. That wouldn’t be anything new — until streaming came along, the independent label and artist ecosystem existed separately from the corporate one with some overlap. The introduction of streaming brought the promise that those sides could live peacefully under one roof (or platform). We’re starting to see the problems and ethical conflicts brought about by that notion. Here’s something from 2019 I wrote on this topic and, surprise, Neil Young plays a role in that post, too.

A Boy Can Dream

Will 2021’s New Music Hold Out For Tours? → One positive thing we can say about 2020, it didn’t lack for great music. Here’s MusicREDEF’s compilation of various 2020′ best of’ lists as proof. For the most part, it didn’t particularly seem like anyone deprived us of their new music this year. In the superstar category, where the absence of touring is a significant detriment on release strategy, artists embracing lockdown life — like Taylor Swift and Charli XCX — prospered. On the other hand, business-as-usual releases from the likes of Lady Gaga and Childish Gambino seemed here and forgotten. 

I think, at first, the uncertainty of the times actually ended up pushing artists to keep the releases flowing. If you remember, there was a time when acts figured they’d be on tour by the summer, and everything would be hunky-dory. There was a feeling that if bands all held their albums for a few months, then there’d be a glut of releases when the time came to tour. So, bombs away. And credit to Dua Lipa for being one of the first to jump in the water, with an end-of-March high-profile album release during the early throes of pandemic panic. Future Nostalgia ended doing quite well for her, giving other acts the nudge they needed. But, most still believed they’d tour in the summer or fall.

2020’s uncertainty is giving way to 2021’s certainty. That certainty is that there likely won’t be any major tours for another year, at the earliest. For that reason, we might see fewer big releases next year or a planned glut of releases (preceding an excess of tours) in early 2022. Here’s Larry Fitzmaurice in the Last Donut of the Night newsletter:

Let’s put visibility aside for a moment (especially when, in the age of social media, it takes a lot to translate that into something you can make a living off of) and talk about the big problem with releasing new music and not touring behind it: No touring means no income, since an increasingly scarce number of musicians can afford to make and release music without touring to recoup the cost of, well, making and releasing music.

Smaller and mid-sized bands are more nimble and can do things that big acts can’t, like book short-notice regional tours and vary the types of venues they play. But there’s also the audience problem — will people be ready to attend concerts before the end of next year? Right now, I’m doubtful. I don’t know if I’ll be comfortable going out until I’m absolutely sure I’m not putting myself and my loved ones in danger. With all the vaccine good news, I hope we can all safely put aside these reservations before we ring in another year. If not, we’ll need all the great new music we can get.

Apple TV Was Making a Show About Gawker. Then Tim Cook Found Out → I have mixed feelings on this story: 

Mr. Cook, according to two people briefed on the email, was surprised to learn that his company was making a show about Gawker, which had humiliated the company at various times and famously outed him, back in 2008, as gay. He expressed a distinctly negative view toward Gawker, the people said. Apple proceeded to kill the project. 

Several episodes were already in the can, so this wasn’t a small decision. And reportedly, there are other things that Cook (and Apple) object to in Apple TV+’s programming. Unsurprisingly, too much violence and nudity (the reason Cook killed a Dr. Dre biopic despite Dre’s involvement with Apple) or religious controversies (crucifixes were removed from Servant) are on the list. But then, supposedly, a scene was excised from a show because the script called for damaging an iPhone. Oh, and no one in a program can disparage China.

That all sounds dicey. But, in a way, I don’t mind the leader of a content platform setting guidelines based on personal convictions that influence the company’s vision. Most platforms are solely profit-driven and have no content guidelines at all (besides the legally enforced ones). Society’s present mess is partly because platforms try to please everyone, even if everyone includes those spreading dangerous misinformation, bullying, and filth. I’m not saying Cook’s personal views and convictions inspire all his policies (unless he really does love China), but I’d like to see more CEOs express convictions that act as constraints on their companies. I think, in this case, saying ‘no’ to Gawker applies.

Of course, there’s the chilling effect. Will studios take chances when having to navigate a CEO’s personality? On the other hand, could this become the differentiation that we miss in platforms? Like radio stations programming by loose definitions of genre, video streamers become separated by content that follows corporate vision. There will always be platforms that take more risks (that’s a corporate vision in itself), complimenting those that want to remain ‘family-friendly.’ Why not?

I admit what I’m proposing is naïve. Reed Hastings pulling an episode of Patriot Act off Netflix because it criticizes Saudi Arabia is not what we want more of. But if Twitter and Facebook suddenly decided that misinformation, hate-speech, and harassment weren’t allowed because it was against what Zuckerberg and Dorsey believed in — I’d enthusiastically welcome that. They are private companies, after all, and can do what they want if they wanted to. 

I know, I know. Just let me enjoy my fantasy for at least a few minutes.

Elijah Knutsen – Music For Vending Machines 1 → Elijah Knutsen, who gave us the exquisite Blue Sun Daydream album a couple of months ago, is back with Music For Vending Machines 1. Elijah refers to this first-in-a-series as “a miniaturized listening experience … much like something purchased from a vending machine.” The three songs, each clocking in at an average length of nine-and-a-half minutes, note a particular noise in their titles: “Air Conditioner Sound,” “Vending Machine Sound,” and “Purple Wisteria Tree Sound.” Those titles are red herrings as these ‘sounds’ are spacious, melodic, and far from mechanical or ordinary. “Vending Machine Sound” in particular gives our ears a visceral variety — layers of mesmerizing, shimmering tones fade into a chorus of voices and footsteps. And then those noises succumb to warm bendy chords alternating in the stereo field, like an interim track on that lost mid-90s My Bloody Valentine album. As with his previous Blue Sun Daydream, Elijah Knutsen’s self-described “micro-release”1It’s still longer than most early Van Halen albums btw. is a gorgeous-sounding diversion, transporting and soothing the listener within its sonic world.

The Shifting Definition of Independent Music

Recently a reader called me out for repeatedly throwing around the phrase ‘independent artist’ or ‘indie label’ without explaining my definition (or if I even had one). Fair enough. Let’s discuss: what does independent mean in 2020?

The ‘indie’ tag has meant less and less over the past thirty years. There was a stark difference between indie and major labels until the grunge years of the early ’90s. The success of Nirvana triggered an ‘indie band’ signing spree that saw a lot of independent labels get into bed with the majors, both publicly and covertly. I remember insiders up-in-arms over The Smashing Pumpkins, whose Caroline Records debut was supposedly just an ‘indie cred’ warm-up to their already planned sophomore album on a major label. Caroline, at the time, was a subsidiary of Virgin, after all. Even then, there were debates over whether an act such as this could be considered independent.

Things seem less complicated now, but only at first glance. One can’t get any more independent than self-released, right? And bedroom labels are rampant, a far distance from the three major label behemoths. But the confusion lies in distribution, marketing, and the third party deals a label or artist signs in the guise of ‘label services.’ Is a self-released artist independent while using a distributor that also controls her publishing? While promoting solely through a social media platform that is the gatekeeper to her fanbase? And while relying on Spotify playlist placements for discovery and traction?

We’re likely splitting hairs. Some of the bands we considered the most independent in the ’70s and ’80s relied on corporate record chains to sell their music, or entered into deals with management agencies and live venue networks. But now there is an air of acquiescence that seems different. Is ‘selling out’ even an available option when the biggest corporations in human history are necessary for exposing one’s music?

This circumstance presents a challenge when defining ‘independent music.’ And this challenge is depressing. If we’re in bed with corporations because of the tools we use, then there’s not much hope for the punk rock dream.

Historically, we’ve looked at independence in terms of control. Who’s in the driver’s seat? I think that stands, even if we need to tweak things a little. It’s natural to call a label or artist who controls songs and revenue flow — traditionally through a distributor — an independent. But even that’s debatable, as Cherie Hu pointed out in a recent post:

… according to Billboard and Nielsen, copyrights owned by Universal Music Group account for a 29% share of the recorded-music market — but if you look at [indie label] catalog distributed by Universal, that share increases to 38%. On the flip side, copyrights owned by indie labels account for 35% of the market, but copyrights distributed by indies account for only 16%. This implies that many artists and labels who we categorize as “indie” actually rely on distributors owned by major labels to release their music — a nuance that can be complicated to discuss in the open.

Also, a difference from decades ago is that the current independent artist must also exert control of her fanbase. In other words, the audience interacts through the proprietary website, or an email list, or at live shows rather than solely through the corporate go-between of social media. As I’ve spoken about before, an independent artist uses social media as a mere tool, not a reliance.

Our definition of independent is increasingly subjective. If Taylor Swift managed to gain control of all her recording masters, publishing, and fanbase access, we could call her a sort of independent artist even when Universal distributes her music. Likewise, an emerging artist on a small independently distributed label, but who signed all his recordings and publishing to the label for perpetuity, isn’t exactly independent.

I believe the title of ‘independent’ now leans towards those who understand and control their rights. It used to hinge on the size and scope of the artist’s associated label, which made the definition easier to suss out. But as more and larger artists continue utilizing 21st-century tools to seize their rights, the meaning of ‘independent’ only gets blurrier.
